MA Malan Attorneys assists couples with antenuptial contracts, notarial life partner agreements, marriage ceremonies and related matters. Our director, Marcus A. Malan, is an admitted notary and a designated marriage officer.
Because we also practise immigration law, we are well placed to assist couples where one or both partners are foreign nationals. We can make sure your marriage or partnership documents also meet Home Affairs’ requirements for any later visa or permanent residence application.
Our Services
- Antenuptial contracts: advice on marriage out of community of property, with or without the accrual system, and the preparation, execution and registration of your antenuptial contract in the Deeds Office. Your contract must be signed before a notary before the date of marriage.
- Life partner and cohabitation agreements: preparation and notarial execution of agreements, including those supporting life partner visa and permanent residence applications.
- Home Affairs marriage interviews: guidance on the required documents and preparation for the interviews conducted where a foreign national marries a South African citizen or permanent resident.
- Marriage ceremonies and registration: civil marriage ceremonies at our Pretoria office, officiated by our director, Marcus A. Malan. We also handle registration of your marriage with Home Affairs.
- Changing your matrimonial property system: joint applications to the High Court under section 21(1) of the Matrimonial Property Act 88 of 1984 for leave to change your matrimonial property system. Once the court authorises it, we execute and register the postnuptial contract.
